Paula Plaintiff’s Really Bad Week, Part 2

Introduction

In this assignment, you’ll need to decide whether Paula Plaintiff has any legal claims arising from another series of unfortunate events. After reading the scenario, answer the questions that follow, making sure to fully explain the basis of your decision.

Paula’s bad luck continues. Five days after the events detailed in your last assignment, Paula returns to work at Capstone Corporation. Unfortunately, she used her company e-mail to send her mom a personal note about her injuries, despite being aware that Capstone’s company policy prohibits use of company e-mail for personal communication. Paula’s supervisor, Mikey Manager, discovers Paula’s violation and Paula is reprimanded. When Paula goes home, she uses her personal computer to post disparaging comments about her boss and Capstone Corporation on social media. The next day, Paula is fired from her job.

After several days of bad luck, Paula believes her luck is about to change. She finds a new job in a nearby town. Paula had been using the bus to go to work at Capstone Corporation, but she will need to purchase a car to commute to her new job. Fortunately, her neighbor Freddy Ford has just purchased a new vehicle and is selling his old Mustang. Paula meets with Freddy and agrees to purchase the Mustang for $1000. The parties also agree that Paula will bring Freddy the money the next day when she picks up the car. The next day, Paula calls Freddy and says, “I have the money. I’d like to come pick up my car.” Freddy replies that Paula is too late. He sold the car earlier in the day.

In a 6–10 paragraph paper, answer the following questions:

  • Does Paula have any legal claims against Capstone Corporation? What about Paula’s actions? Does Paula have a contract with Freddy to purchase the car? Consider the following:
    • Does Paula have a right to privacy when using Capstone Corporation’s e-mail system? Discuss one’s right to privacy and relate it to the facts in the scenario.
    • Can Paula be legally fired from her job for making negative comments about her boss and her company on social media? What about free speech? Discuss these issues and relate them to the facts of the scenario.
    • Do Paula and Freddy have a contract for the sale of the Mustang? Discuss the elements of a contract and relate those elements to the facts of the scenario.

Quality Health Care Management Paper 

You are a quality analyst in a health information management (HIM) department appointed to lead a project team. Your team must assess the problem with the documentation of the patient’s discharge disposition status in the health record and present your findings in a meeting to the department. 

An increasing number of errors have been reported, and frustration among the coders has risen. These coders claim that conflicting information is often present in the record, requiring them to spend an inordinate amount of time trying to obtain verification. Coding productivity has been affected. Explain how you would assess the problem, strategies that you may develop to resolve the problem, and a way to study the effectiveness of your strategies.  Give examples of tools you would use to present your findings in the meeting.

Directions

Post a question based on an article, book, video, podcast, or any other current (less than 4 years old) material relevant to the current unit’s key topic. You are encouraged to use the Park course library to find an article.  The article must support a business case for HR management. Each student must post a question based on their article no later than Tuesday of each week in order to receive full discussion points. If you miss the Tuesday deadline ten percent will be deducted from the final discussion grade for the week. The Tuesday deadline enhances the discussion area and provides others with an opportunity to comment on your posts. 

Each student must also respond (reply) to at least two other student’s posted questions, a student’s response to a question, or to instructor input.  Two peer responses are due each week.

All initial questions input must be accompanied by a summary of the selected article. There is no length requirement for the question. However, the question must be comprehensive (a summary analysis of the key article points followed by a question that cannot be answered with a simple yes or no response. The peer responses are required to be comprehensive and clearly state your reason for agreeing or disagreeing with the post in a professional manner. Peer responses are not just short responses like: “I agree.”  Peer responses must include data or other information that makes an HR business case for the response (with at least one source for support).

MEDICAID ELIGIBILITY AND FINANCING

 

The United States is one of the remaining countries in the developed world that does not have a single-payer health care insurance system in place. With the future of the Patient Protection and Affordable Care Act being uncertain, we hear continuing discussion as to whether the United States could (and/or should) adopt a single-payer system. Could a single-payer system be possible, even though it is forecast to cost trillions of dollars? How would it affect health care costs, coverage networks, types of covered vs. noncovered services, patient waiting times (for appointments, testing, procedures, and surgeries), coinsurances, and (finally) our taxes? Would currently working employees be required to give up their existing coverage for what will be provided under the single-payer system?

Once you have read the assigned background readings, as well as completed some peer-reviewed research of your own, address the following:

  1. Describe an example of how a single-payer system (such as ‘Medicare For All’, as just one example) works in the United States.
  2. Looking at examples of other countries with a single-payer system, what are the specific benefits of having such a single-payer system? Include at least three specific benefits, citing credible sources for your facts.
