  • Identify and discuss one exception to the employment-at-will doctrine.

  • Describe one commonly found workplace tort and provide a current news story detailing a successfully brought suit for the tort selected.

Human Resources

George Jotson, sole shareholder and chief executive officer of Orbital Sprockets Incorporated, wanted to develop a qualified pension and profit sharing plan for his 1,250 employees. Of the 1,250 employees, only 30 employees earned over $100,000 in 2016. Jotson was concerned with high turnover in the manufacturing plants and so he wanted to restrict plan participation. Orbital’s qualified pension plan has the following requirements:

·Minimum plan entry age of 35.

·Minimum plan waiting period of two years.

·Plan vesting should be immediate

·Plan participation should be limited to employees who earn over $100,000.

Rosa Singleton, age 28, has been an employee of Orbital for the last 6 years. She earns $50,000 a year but wants to participate in the pension plan. When she is told she does not qualify, she sues Orbital.

Part 1: Discuss the issues and determine how a court is likely to rule.

Most claims involving sexual misconduct in the workplace (such as sexual discrimination and sexual harassment) are resolved with a settlement between the complaining party and the employer. These settlements typically contain nondisclosure provisions (also known as a “Non-Disclosure Agreement”, or NDA) that prohibit the complaining party from discussing information about their claim or the settlement agreement itself, with very limited exceptions.

In the wake of recent sexual misconduct claims by women against high-profile men in a number of business enterprises, including the news and entertainment industries, legislators, attorneys, and legal experts throughout the country are considering whether Non-Disclosure Agreements should be prohibited in settlement agreements involving sexual misconduct, both within and outside of the workplace. Some states, such as Washington and New York, have enacted legislation banning NDA’s in settlement agreements involving sexual misconduct, while several other states are contemplating similar legislation. Those who support a prohibition of NDAs in sexual misconduct claims argue that employers and individuals who engage in sexual misconduct should not be permitted to “buy” the silence of the victims. Opponents of prohibiting the inclusion of NDAs in settlement agreements contend that the NDAs provide an incentive for employers to settle sexual misconduct claims, and that without non-disclosure provisions, employers will force complainants into costly and time-consuming litigation. What is your opinion of requiring Non-Disclosure Agreements in settlements of cases involving sexual harassment/misconduct? Please explain your reasoning.

Option #2: Self-Managing Teams in S.C. Johnson & Son

Many have strong views on self-managed teams (SMTs) – they are either perceived as great resources or viewed as a complete waste of time and detrimental to an organization. With this in mind, evaluate the SMT process put together by S. C. Johnson Companies South America as explained in Chapter 31 (Rainieri, 2018) and its potential for success in other parts of the globe. As part of your evaluation, explain the considerations or adjustments that were made for the implementation of these teams at company’s location in Chile, and how these differed from processes in other locations. Conclude your evaluation with recommendations for SMT processes or components that could contribute to greater success of SMTs throughout the world.

Using the scenario from Assignment 1, write a six to seven (6-7) page paper in which you:

  1. Identify three (3) job requirements (e.g., needed certifications, previous work experience, external influences, etc.) that could apply to your chosen scenario. Determine two (2) ways these requirements could impact staffing at your organization. Next, suggest one (1) strategy that you could utilize to ensure that all applicants meet the identified job requirements for your organization. Justify your response. 
  2. Outline a long-term recruitment plan that contains at least four (4) components, is aligned with your company’s recruitment strategy, but also addresses possible job skill or credential shortages. Note: Consider concepts such as succession planning and hiring retirees. 
  3. Describe three (3) branding strategies that you would employ to attract qualified applicants to your organization. Next, suggest three (3) communication methods that you would utilize to reach out to applicants. Predict the outcome of integrating your branding strategies and communication methods at your organization. Provide a rationale for your response. 
  4. Determine two (2) selection processes for recruiting new employees that could apply to your chosen scenario and then identify five (5) selection criteria that you could use when hiring new employees. Next, analyze the effect of the five (5) identified selection criteria on long-term employee retention and preservation of organizational knowledge. Justify your response. 
  5. Suggest two (2) assessment methods that you could employ to select new employees for your organization and then analyze the validity and reliability of each method in regards to the job your organization is offering. Next, identify four (4) job predictors that you believe can assess candidates’ knowledge, skills, abilities, and other skills and experiences (KSAOs). Provide support for your rationale.

  7. Format your assignment according to the following formatting requirements:
