- Resource: Grading Guide: FMLA, Labor Law, and OSHA
You are a first-year Human Resource Specialist at “State of Estates” estate planning firm. Norman is the mid-level manager responsible for the southern regional office. The following events have recently occurred in Norman’s office:
- Ken, an estate planner in Norman’s office, recently adopted a baby with his wife. He applied for 12-week family leave, but was denied by Norman because his wife did not physically give birth. The corporate human resource department (where you work) was not given notice of this decision.
- June, part of the full-time housekeeping staff, has been asking other employees if they would like to join a union. There are currently no unions within the organization.
- Maria is concerned about ladders that are placed around the office for remodeling. Norman said not to worry, and that there are no official policies for safety in an office setting.
- Prepare a 15- to 20-slide Microsoft® PowerPoint® presentation with speaker notes responding to Norman from a Human Resource standpoint. The presentation should address the following topics:
- An overview of the FMLA and its key provisions relating to Ken.
- Recommended resolution for Ken’s situation (both for Ken as an employee and as a company handling these requests moving forward).
- An overview of key labor laws to briefly educate Norman on employee rights in unionizing.
- A brief discussion of OSHA and possible application to Norman’s office setting.
- Format your presentation consistent with APA guidelines.
Discussion
Research suggests that being a good public speaker can help individuals grow their business, advance their career, and form strong collaborations (Tsaousides 2017). However, communicating your ideas clearly and presenting them in public can prove to be a challenge. For this forum, discuss what researchers believe are the top reasons for public speaking anxiety or fear. Determine if any of these reasons are applicable to you and what would be the best remedy to overcome these fears.
Homework Question
One of the ways management can manage difficult situations, collect relevant information, and build common ground and trust with employees is establishing communication based on evidence rather than judgment.
Using the final project transcripts provided, create a list of the relevant facts that are pertinent to the case. This is information that you would use to determine the outcome of the case—or evidence. Additionally, create a list of judgment comments you find in the transcripts. Judgments are information that could not be used to defend the actions in the case because they are feelings, emotion, or opinion—not fact.
Assignment
In this course, you will be asked to select one case study and to use it throughout the entire course. By doing this, you will have the opportunity to see how theories guide your view of a client and the client’s presenting problem. Although the case may be the same, each time you use a different theory, your perspective of the problem changes, which then changes how you go about asking the assessment questions and how you intervene.
The first theoretical approach you will use to apply to a case study is systems theory. In other words, your theoretical orientation—your lens—will be systems theory as you analyze a social work case study.
Different theories can be used to take a systems approach. For example, Bertalanffy’s General Systems Theory considers how a system is made of smaller subsystems that influence each other and seek homeostasis, whereas Brofennerbrenner’s Ecological Systems Theory focuses on how an individual’s experience is influenced by different system levels (micro, meso, exo, macro, and chrono). Systems theory is commonly used to understand the interrelationships of the systems (e.g., family, community, organizations, society) of the client. If you are working with families, communities, and organizations, it is also beneficial to use systems theory to get a holistic picture of all the interrelated parts of the system.
To prepare: Select and focus on one of four case studies listed in the Learning Resources. You will use this same case study throughout the course.
- Focus on the identified client within your chosen case.
- Analyze the case using a systems approach, taking into consideration both family and community systems.
- Complete and submit the “Dissecting a Theory and Its Application to a Case Study” worksheet based on your analysis.
